Delta man charged after threat to judge...

On Sunday, Hammers conducted several arraignments at the courthouse. He called a recess at 3:30 p.m. to allow Magistrate Beth Spalding to hear Cunningham's case. Hammers sat in the court room in street clothes as Spalding explained to Cunningham via video conference from Fairbanks Correctional Center that, since he is charged with a felony, a judge must hear his plea. She set his preliminary hearing for Nov. 9.

Assistant District Attorney Jason Weiner requested bail be set at $150,000 with a third party custodian, due to the nature of the charges and Cunningham's record, which includes disorderly conduct, unlawful contacts, violation of protective orders, larceny and DUI.

"In this case he threatened a justice member's family for doing their job," Weiner said.

Cunningham had little to say in response to the bail recommendation.

"If you feel just with that, that's fine with me," he said. "But it's kind of like an impossibility."

If Cunningham is able to post bail, Spalding set several other conditions of release including staying away from Hammers, his family, his residence and any witnesses to the case. Cunningham must also stay at least 1,000 feet away from Rabinowitz Courthouse except when he has scheduled hearings.

According to a court records search, Cunningham has appeared before Hammers in other cases including a hearing in October 2004 for a DUI that Cunningham pleaded guilty to. Hammers sentenced him to several of the same conditions used in similar DUI cases.

Troopers on Sunday would not release any additional information about the letter addressed to Hammers. Trooper Allen Carvajal said the threat was taken seriously because of the nature of the threat and that it was directed at a court officer. Carvajal said the courthouse was not evacuated on Friday, but additional patrols by troopers and police were scheduled until Cunningham was arrested.

"It did require for us to take it seriously and expend additional state resources," he said.
