Fremonter seeking motion to withdraw pleas...

Randall C. Redding, 42, was sentenced Sept. 14 to nine months in jail for resisting arrest, a Class I misdemeanor, and disorderly conduct, a Class III misdemeanor.

He was allowed to remain free on bond after his sentencing, pending a planned appeal by his attorney. Instead of an appeal, the motion to withdraw Redding's pleas was filed.

Court records said Redding was accused of injuring his son by head butting him, refusing to talk with a police officer and - with the help of others - attempting to throw the officer downs some steps and off a deck.

Redding's attorney argued that when his client made his pleas, Redding did not know about allegations of him threatening to throw a police officer off a deck, otherwise he would not have pleaded to the charges.

“It's simply a matter of after the plaintiff received a nine-month sentence, he no longer liked his plea agreement," Boyer said. “The argument does not hold water."

* Richard A. Haase, 18, of Fremont pleaded guilty to driving under the influence-first offense, a Class W misdemeanor, and possession of marijuana-less than an ounce, an infraction. In exchange for his pleas, a charge of carrying a concealed weapon, a Class I misdemeanor, was dismissed. Haase was sentenced to six months of probation and fined $500. As part of his probation, he must attend a defensive driving class, a victim's impact panel, a chemical education class and five Alcoholics Anonymous meetings. He also must perform 60 hours of community service and his driver's license was revoked for 60 days.

* Diane K. Keller, 36, of Fremont was found guilty of no proof of insurance, a Class II misdemeanor, and speeding, an infraction, after a trial. She was fined $175.

* Timothy A. Rudder, 23, of Fremont pleaded guilty to DUI-third offense, a Class W misdemeanor.

A pre-sentence investigation was ordered and sentencing was set for Dec. 13.
